Ann Arbor Operating While Intoxicated Attorneys

Many people are familiar with the terms DUI and DWI, but some are less familiar with OWI — operating while intoxicated. This charge can be just as serious. It is often charged in cases where the driver is accused of operating a vehicle while under the influence of drugs. This could be either illegal drugs or even prescription drugs that impair driving ability.

Breath Tests Are Not Foolproof

No machine is foolproof, including the breathalyzers that police use during DUI stops. These machines can give false readings of intoxication because of medical or dental issues not related to drugs or alcohol. Furthermore, if these machines are not properly maintained and calibrated, the results of breath tests are worthless. We will review these tests carefully.

OWI and OWVI

In addition to OWI, Michigan also has a charge called operating while visibly impaired (OWVI). This means that the police officer believed that the driver was visibly impaired by either alcohol or some type of drug, such as marijuana or cocaine. While this is a lesser offense than other drunk driving charges, it can come with serious consequences. We can defend you.
