Resolving Credit Card Debt Through Bankruptcy

Many people find themselves faced with overwhelming debt. Often, credit card debt is a big part of the problem. This debt may be the result of turning to a credit card to pay for things after job loss or some other loss of income. Credit cards may have been used after divorce when adjusting to life with one income instead of two, or after a medical emergency to pay bills. For some, the problem is made more difficult by the high interest rates that come with these cards.

What Can Bankruptcy Do For Credit Card Debt?

Credit card debt is a type of unsecured debt. Like most unsecured debt, it is easily eliminated through both Chapter 7 and Chapter 13 bankruptcy. Time complications may arise if you have used the credit card within 90 days of filing bankruptcy.

In Chapter 7, the credit card debt will be completely discharged. In Chapter 13, the credit card debt will be included in your repayment plan. The credit card company may receive some portion of your monthly payments, although that may be a very small portion. Any credit card debt not paid through the repayment plan will be discharged upon completion of the plan. The credit card company may have been paid off as low as five percent or as high as 100 percent.
